PBM Products, LLC won against Mead Johnson in a recent lawsuit for false advertising, with PBM refuting the latter’s claim that store-brand formula is not as nutritious as the more expensive formula that Mead Johnson carries.
In a decision that might be a turning point for all baby formulas in the United States, the jury determined that Mead Johnson is making untrue claims about their product (Enfamil® LIPIL®) being superior than PBM products retailed by Walmart, Sam’s Club, Target, Kroger, Walgreens, and other retailers. It is a fact that the manufacturing of all baby formulas in the U.S. are regulated by the FDA, which means that all brands follow the same exacting standards, and no brand is more or less nutritious than the other.
This means that parents have been blindly paying hundreds of dollars more annually for baby formulas that are not in any way different than the store-brand formulas like PBM products sell in the market. The jury demanded that Mead Johnson pay $13.5 million worth of damages to PBM Products as a result of their false advertising. This decision does not only affect both companies, but parents as well. This shows that there is no sense in buying national brand name formula products as store-brand formulas are as nutritious as the more expensive options.
Even my daughter’s pediatrician doesn’t really recommend any brand to our little girly. I always confirm to her, is this (brand) really good for her. She will always say, “Just look at her. If she’s healthy, then it’s good. You can give her whatever (brand) you want, expensive or not.”
